Terms and Conditions

Customer – a natural person who has reached the age of 18 or a natural person who carries out an economic activity, or a legal person who purchases a product in the online store www.lamarek.net for final consumption (i.e. without the right to resell and/or use the product for other commercial purposes) and has ordered The recipient of the Product, who at the time of receiving the Product and Services can present the confirmation information "The order is ready for delivery" received by e-mail or phone to the Seller and/or name the Order number.

Product – a material unit that is in circulation and thus offered for sale on the website.

Order – the Customer's request for the delivery of the selected item on the website to the address specified by the Customer has been duly completed.

General rules

By ordering a product through the online store www.lamarek.net, the Customer agrees to the terms of sale of the product (hereinafter referred to as the Terms), which are explained below.

Mutual relations between the Customer and the Seller are regulated by the legislation of the Republic of Latvia.

The seller reserves the right to amend these Terms.

Forming the order and its execution terms

The customer can complete the Order with the desired product. A basket of goods is created based on the customer's choice.

When placing an order, the Customer provides the following information:

Recipient's Name, Surname; Delivery address; Contact phone number; Electronic mail address.

After successful completion of the Order, information about the status of the Order is sent to the Customer's e-mail address. The status of the order indicates the processing stage of the Customer's order.

If the Customer placed an order for goods in a quantity that exceeds the quantity of the specified goods in the Seller's warehouse, the Seller informs the Customer about this by sending an electronic letter to the electronic address that the Customer specified during registration. The customer has the right to pay for and receive the product in the quantity in which the product is available in the warehouse, or to cancel the given position in the order or, as an alternative solution, to accept the seller's proposal for postponing the execution of the order until the specified product is available in the seller's warehouse in the necessary quantity. If the Customer has not coordinated his decision with the Seller within 7 working days, the Seller has the right to completely cancel this order.

The customer must choose one of the possible payment methods (more information - Product payment policy). The customer confirms that he will be at the specified address at the selected time.

The information materials placed on the website cannot fully reflect the characteristics of the product (including color, dimensions, technical parameters, shape). Before placing the Order, the Customer has the right to contact the Seller to clarify the details of the Product. If the Customer has not turned to the Seller for detailed explanations, it is considered that the Customer has no doubts about the characteristics of the product when placing the order.

In the event that the goods are not in the Seller's warehouse in the required quantity, including for reasons beyond the Seller's control, the Seller has the right to cancel the given position in the Customer's Order, informing the Customer about it by sending a notification to the electronic mail address that the Customer specified when registering on the website.

In all cases, it is considered that the Customer, by placing the Order, has familiarized himself with and agreed without objection to all the Seller's terms and conditions, as well as to all other conditions specified in the Order.

Orders are processed every working day from 10:00-15:00.

Shipping Policy

The seller undertakes to deliver the product within 2-4 working days after sending the order confirmation to the customer. This term does not apply to cases when www.lamarek.net does not have the necessary goods in stock, and the Customer is informed of the shortage of the ordered goods. At the same time, the Customer agrees that in exceptional cases, delivery may be delayed due to unforeseen circumstances. In this case, www.lamarek.net will immediately contact the Customer and agree on the delivery of goods. The product is delivered to all regions of Latvia.

When placing an order in the shopping cart, you can choose the method of receiving the goods:

Delivery via Omniva parcels throughout the territory of Latvia (prepaid).

Delivery via DPD parcels throughout the territory of Latvia (prepaid).

The product can be received at Rīgas iela 26, Valmiera, Latvia, LV4201 by mutual agreement in advance.

To find out the exact cost of delivery of your order, put all the products in the virtual cart and go to "Cart". Choose the delivery method, and the system will indicate the exact delivery cost of your order.

The Seller does everything that depends on it to meet the specified delivery dates, but despite this, delays in the delivery of the Product directly from the Seller are possible for independent reasons.

Orders that are confirmed are placed for next business day delivery.

The customer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, but the goods have been delivered to the specified address based on the information provided by the Customer, the Customer is not entitled to make claims against www.lamarek.net due to unsatisfactory delivery of the goods.

In all cases when the courier delivers the product to the buyer, if the package of the package is wrinkled, wet or otherwise damaged from the outside, the Customer must indicate (write a comment) in the confirmation of receipt of the package or write a separate document about such defects. The customer must do this in the presence of the courier. Yes, such action has not been taken, www.lamarek.net is released from responsibility towards the Customer for the goods, if the Customer has not described these damages in the goods delivery confirmation.

In cases where the Customer, upon receiving the goods, notices that the shipment does not contain the corresponding goods or the goods are not the correct size, color or other inconsistencies, the Customer must immediately inform www.lamarek.net.

The risk of accidental loss or damage to the product passes to the Buyer at the moment the Customer receives the Order.

In cases where the Product has not been delivered to the Customer due to its loss due to the fault of postal (courier) service employees at the time of delivery, the Seller reimburses the Customer for the paid product and delivery value only after the Seller has received a certificate of loss or compensation from the postal service.

The Order is delivered to the Customer or the person indicated in the Order as the recipient of this Order.

Payment of the product

The price of the product is indicated on the website. In the event that the wrong price of the ordered Product was indicated, the Seller informs the Customer at the first opportunity to cancel or confirm the Customer's Order. If it is not possible to contact the Customer, the said Order is considered cancelled. If the Order was paid, the Seller returns the payment amount.

The customer pays for the selected item with one of the payment methods offered by www.lamarek.net:

When making a prepayment when paying an invoice or using the payment card platform PayPal (www.paypal.com).

If the Customer chooses the online payment method, then he undertakes to pay for the goods immediately, otherwise he loses the right to raise claims for violation of the time of delivery of the goods, since the customer's order is created only after receiving payment for the goods.

The Seller has the right to grant the Customer discounts on the Product and offer the Customer to participate in loyalty programs. The seller has the right to amend them unilaterally.

Return and Refund Policy

We have a 14 day return policy which means you have 14 days after receiving the item to request a return.

To be eligible for a return, the item must be in the same condition as when you received it, unused, with tags and in the original packaging. You will also need a receipt or proof of purchase.

You can contact us at info@lamarek.net to initiate a return. If your return is accepted, we will send instructions on how and where to send your package.

Items sent back to us without a return request in advance will not be accepted.

Damage and problems

Please check your order upon receipt and contact us immediately if the item is damaged or you receive the wrong item so that we can evaluate the problem and correct it.

Exceptions / Non-returnable items

Custom products (such as special orders or personalized items). Unfortunately, we cannot accept returns on sale items or gift cards.

Change

The fastest way to ensure you get what you want is to return the existing item and once the return is accepted, make a separate purchase for the new item.

Refund

We will let you know when we have received and inspected your returned item and let you know if the refund has been approved or not. If approved, you will be automatically refunded to the original payment method. Refunds are made within 7 to 30 days. Please note that it may take some time for your bank or credit card issuer to process the refund as well.

Intellectual property

Copying of all textual information and graphic images published on the website is prohibited. The names of brands, trademarks and logos displayed on the site belong to their respective owners.

Warranties and liability

The Seller is not responsible for the loss incurred by the Customer as a result of improper use of the Product.

The seller is not responsible for the content and functionality of external websites.

The Seller has the right to give back or in some other way transfer his rights and obligations in mutual relations with the Customer to third parties.

Product descriptions in the online store www.lamarek.net are only informative and the use of this information does not create legal obligations between the visitor and the owner of the online store. Goods The accuracy of the text may not meet the criteria of the buyers' informational request.

The owners of the online store www.lamarek.net are not responsible for transferring the color parameters of the photos to the buyer's display.

2. The controller processes only the customer's identification and contact information, which is necessary for the execution of the purchase contract;

3. The controller processes personal data for delivery and accounting purposes, and for the necessary communication between the contracting parties for the period specified by law. Personal data will not be made public and will not be transferred to other countries.

Purpose of data processing

The Controller processes the Customer's personal data for the following purposes:

1. For registration on the website www.lamarek.net in compliance with GDPR Chapter 4, Section 2;

2. To fulfill the electronic order created by the customer (name, address, e-mail, phone number);

3. To comply with laws and regulations resulting from the contractual obligations between the Client and the Controller;

4. Personal data is necessary to fulfill the purchase contract. A contract cannot be concluded without personal data.

Duration of storage of personal data

1. The controller stores personal data for the time necessary to fulfill the rights and obligations arising from the contractual obligations between the controller and the client, and for 3 years after the termination of the contractual obligations;

2. The controller must delete all personal data after the expiration of the personal data storage period.

Recipients and processors of personal data

The third parties that process the Customer's personal data are sub-companies of the controllers. The services of these sub-companies are necessary for the successful execution of contracts for the purchase of electronic orders between the Controller and the Client.

Controller sub-companies are:

Webnode AG (Internet shop system);

Delivery companies: OMNIVA SIA, DPD Latvija SIA;

Google Analytics (home page analytics);

Customer rights

According to the regulation, the Client has:

1. The right to access personal data;

2. The right to correct personal data;

3. The right to delete personal data;

4. The right to object to the processing of personal data;

5. Right to data portability;

6. The right to withdraw consent to the processing of personal data in writing or via e-mail sent to: lamarek@lamarek.net;

7. The right to submit a complaint to the supervisory authority if a violation of the regulation is suspected.

Security of personal data

1. The controller undertakes to take all technical and organizational precautions necessary for data protection;

2. The controller has taken technical precautions to ensure secure data storage by providing access to the computer with a password, using anti-virus software and performing regular computer maintenance.

Final terms

1. When placing an electronic order on the website www.lamarek.net, the Customer confirms that he is aware of all personal data protection conditions and fully agrees with them;

2. The customer agrees to these terms by checking the box in the order purchase form;

3. The Controller may renew these Terms at any time. A new, updated version should be published on your website.
